Terms & Policies


ORDERING INFORMATION: Thank you for ordering from Mer-Sea & Co. We hope you enjoy our products. Please read our terms carefully. All of our candles and most of our products are hand-poured to order, so please allow at least two weeks for fulfillment. Mer-Sea specializes in gifts, lifestyle and state of mind products. We are excited to be working with you! 

ORDERING: Please place written orders through sales representatives, trade shows or by contacting Mer-Sea directly through email or fax. Orders will generally not be shipped until payment has been received.

MINIMUMS: Upon approval as a DEALER, minimum opening orders are per approved resale location as follows: AT HOME/BAIN DE MER/LUXE/TRAVEL WRAPS-SWEATERS: $500 min; TRAVEL ACCESSORIES: $100 min. Orders not meeting $500 minimum will be subject to a $300 per line minimum. All potential retailers are subject to geographic approval. Mer-Sea retains the right to protect territories for current customers. Previously established accounts that have not placed a reorder within 12 months of last order will become inactive. To be reinstated, inactive accounts will be subject to reassessment and may be reopened at Mer-Sea’s sole discretion. Reorders are $100 min. per resale location.

PAYMENT OPTIONS: Credit cards or prepayment with company checks accepted. Opening orders for new retail accounts must be established with a credit card. Subject to Mer-Sea’s discretion, a limited offering of Net 30 terms and credit will be available based on credit references and credit history, once three paid orders and $2,000 in purchases have been fulfilled.

TERMS: Mer-Sea products can be sold for retail purposes only and cannot be redistributed at a wholesale price. Retailers agree to adhere to MSRP, not including shipping. Retailer’s shipping address is the only authorized site for retail sale. Any additional locations must be pre-approved in order to protect our existing retailers. You may not sell Mer-Sea products ONLINE, including third party websites such as eBay and Amazon, WITHOUT EXPRESS WRITTEN APPROVAL from Mer-Sea. Failure to comply may lead to the immediate cancellation of the account. Mer-Sea actively monitors third party websites for violations.

RETURNS:  Please contact Mer-Sea immediately to obtain approval for returns or exchanges. A 15% restocking fee may apply. Return freight charges will be the responsibility of the retailer UNLESS Mer-Sea is at fault.

CLAIMS: Please carefully review your goods upon receipt. Claims must be made within 10 days upon receipt of shipment. A photo of contents and damaged outer packaging/boxes may be required to settle a claim with the freight carrier.

PRODUCT VARIANCES: Many of our products are hand-poured and hand finished and may have variations in color and replication.
 
COMMON SENSE CAUTION: Remove all packaging before burning candles. Burn within sight. Keep away from things that catch fire. Keep away from children and animals. To reduce sooting, trim the wick to ¼ inch each time the candle is to be lit. Avoid using in drafty areas. Do not burn candle for more than three hours at a time.

LOYALTY PROGRAM:
 Membership in the Program is available to any United States resident who is at least eighteen (18) years old and provides valid and accurate personal information when enrolling. Once enrolled into the Program, you will enter at the member status level and are entitled to the rewards and benefits of membership as set out herein or in promotional materials.

Members must maintain an active Program membership to earn and redeem points. You may opt out of the Program at any time. If you opt out of the Program, you will no longer earn points or be able to redeem points and you will forfeit your unused and unexpired points. Deletion of points is final and cannot be reversed. To cancel a Program membership, please call Customer Service.

Points have no monetary value and they will not expire if you make at least one purchase every 12 months. Points expire after 12 months if you do not make any purchase in the 12 months after earning them.


Please note that points cannot be earned for: any purchase made using a reward coupon; store credit or merchandise credit; charity donations; purchase of a gift card; or the value of any gifts-with-purchase. All other purchases will be qualifying purchases. 


The tier level of your membership is based on the points earned during the current or previous Membership Year whichever is the highest. If you are a new member, or do not have sufficient points to qualify you to the second membership tier level, your membership tier level will start at the first tier. If you reach the second tier during a Membership Year you will stay at the second membership tier level during the rest of the Membership Year and the following Membership Year. If you during the Membership Year do not accumulate sufficient points to qualify you to the second membership tier level, you will return to the first tier for the following Membership Year.


We reserve the right to cancel or suspend your participation in the Program or any Rewards earned and not yet used in the event of fraud, abuse of rewards privileges, violation of these Program Terms and Conditions, or at our discretion. 


Reward points cannot be combined or shared between accounts and accounts created for this purpose can be canceled at our discretion.


We reserve the right to cancel or suspend the Rewards Program and any rewards at any time.

To the fullest extent permitted by applicable law, no responsibility or liability is assumed by the Sponsor for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Program and/or Site.
